‘Svastrino Consultancy Service’ provides its personal and career counselling and mentoring services that are a fusion of unique programs and courses through its website that is termed as ‘Svastrino’ and is visible on the web through the domain https://www.svastrino.com/ .
Offerings/ Services:
The personalised Life & Career Counseling & Mentoring programs that Svastrino Consultancy Services offer under the menu option ‘Services’ are called or named as ‘Bulls Eye Program, Bloom Program and Breakthrough Program’ which are a combination of life and career development programs through which any prospect can get into a Personalised Counselling & Mentoring programs to build their life and career in a way that suits their current situation, needs and future desires. Svastrino Consultancy Service also provides various Skill-Building courses under the banner ‘Skill-Build’ through the same website mentioned above and the 2 offerings in this division are called ‘Nirmaan’ and ‘Psychometric Testing’. These offerings are different in their forms. ‘Nirmaan’ is a pre-recorded course for individuals who want to build themselves (mind-sets, attitudes, patterns, routines, habits, decisions, actions, experiences, etc.) before building their careers and ‘Psychometric Testing’ is a scientific testing that helps individuals to understand their preferences, interests and drawbacks so as to explore the related career options accordingly both of these Skill-Build offerings are common formats for each individual's life and doesn’t have any space for personalisation or alteration unlike the programs guided above. All of these programs and courses, testings guided above and once to be launched in the future will be called ‘Services’ throughout this agreement.

The website also guides up-to-date information on the various courses/ careers through its career Library and blogs that are guided on the website. The website as being unique in its own way also has a list of FAQs that are also guided in a separate page so as to help the Receiver/s understand the details of each Service and the website as a whole. The website also guides testimonies of some of its past students as success stories. Going forward these Blogs, Career Library, FAQs and Success Stories will be termed as Information thorough this agreement.
Purpose:
The purpose of ‘Svastrino Consultancy Service’ is to build a ‘Career Development Ecosystem’ that help students, youth, teens, candidates and anyone looking for life and career development Services to reflect and understand their potential, explore, test and decide future education and related course/ career options through their processes.
Terminology:
Hereon throughout this agreement, Svastrino, its owner firm ‘Svastrino Consultancy Services’, its website and its full time employees of the firm, the 3rd party agencies working on project work will be termed as the ‘Provider’ of the services & information on the Svastrino Website. And, the current visitor or the user of this website (anyone accessing the website) can be a student, youth, teen, candidate (individuals receiving or intending to receive our services), parent, elder of the student, guardian to the student (adult/s responsible for a minor student), educationist (an individual from the education industry), an institution (School, College, Coaching Academy, University, or any educational body who is into direct or indirect structure of providing education) or any individual representing any educational institution, or any person desiring to avail our services, a prospect as a site visitor, as a user or a paid customer of the services (person/entity purchasing a service) offered on the Svastrino website, they can be any gender as described under the Indian Constitution, and here on will be termed as the ‘Receiver’ of the Services and information guided on the Providers website.
Binding Terms:
Following Terms set forth the Terms and Conditions under which any Receiver/s may use our website. By accessing or using the website and/or Services, you approve that you have Read, Understood, Agreed and Accepted to be bound by these Terms till the time any Receiver/s uses the website, its services and information guided by the ‘Provider’. Going forward it is expected that the Receiver/s has read, understood and accepted the terms and conditions mentioned below in the way it is without any exceptions. If the Receiver/s is not aligning with the terms and conditions it is expected that the Receiver/s does not use the website [https://www.svastrino.com/], its services, or consumes any of its information as guided on the above mentioned website by the Provider.
Limitation by age:
In order to use our website and/or receive our services or to consume information guided on the above mentioned website, the Receiver/s must be at least [18] years of age, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. Receiver/s who are below the age of [18] are expected to use our website and its services, and information under the supervision & guidance of any adult from their family or surrounding. It is understood that the Receiver who is under age is using the website and its services with consent from their parent/ guardian till the time the services aren’t exhausted or completed. Receiver/s below the age of [18] who are not guided by any adult are requested to seek support and guidance from any family member or adult before using our website or enrolling for any of our services or before consuming any information guided on the website, if the minor isn’t assisted and if the minor doesn’t have consent of their parent/ guardian then it is requested to that minor to not use our website, its service or consume any information until you have the consent for the same on until you have turned 18 and have the legal right to use our website, its services and its information.
Website Flow Process:
This is where the Receiver/s will get the detailed information of all available Services and Information on the website. The website functions in the following way.
Any Receiver who is visiting the website will initially
- Explore the Website, its services and Information.
- Then they will Select their preferred Service - Programs, as per their need and desires
- Post the selection of the service-program they will Register/ Enrol & pay for the same
- Once they have paid, then they can start to Get the Service for which they registered. If it's a program, the Provider will be in constant touch with the Receiver/s to navigate them through the further stage.
- Here Receiver/s would have Access to the user page which is only available to all the active users. Through which they can Participate, Complete and Track their Service development and further they can guide inputs of their regular progress on the dashboard.
- If the Receiver/s have registered for a Skill-Build Course then they will have to Register/ Enrol & pay for that specific course.
- Once they have paid, then they can start to Get the Service for which they registered.
- As it’s a course the details of their next step will be guided on their dashboard with a progress bar and their current status.
- Here Receiver/s would have Access to the user page which is only available to all the active users. Through which they can Participate, Complete and Track their Service development and further they can guide inputs of their regular progress on the dashboard.
- If the Receiver/s enrol for the Psychometric Testing then once they Enrol and Pay for that specific service, they would have to Complete the Assessment post which they would Get Their Report with a video link on how to Read and Understand the assessment report.
We insist the user to have one specific device to be used throughout the use of any specific service (Programs, Courses or Informations) so as to receive a seamless, uninterrupted service experience.
For Programs:
The Receiver/s of the website can explore any page/s that is being made visible by the Provider. The website is made for the sole purpose that the Receiver/s can understand various programs that are guided by the Provider and then book in any of their preferred programs by making an advance payment and accommodating the preferred slot from the calendar to receive those services. Once the program is served the Receiver/s can book another slot by following the same process of bookings anytime in the future. The payments for the programs that are to be booked are to be done in full and in advance only or as per the payment options guided on the payment page of that website. The programs will be served as follows: Initially the Receiver/s will have to fill a presession enquiry form, this form has specific details on students academic background till date and some ideas on their future development. Then the provider will study the form and keep all the details ready as per the requirement of the 1st actual session to furnish this Personalised Counselling or Mentoring Session. A slot will be blocked by the Provider and then the 1st session will be conducted as planned. This session will be on an average 2 hours long and can extend to max 3 hours depending on the problems discussed and solutions planned. Post the session, self-reflective, self-developing tasks will be provided to the Receiver/s. Then weekly follow-ups will be conducted by the provider to keep a track of the progress. Intermediate support, guidance, and assistance will be provided to the Receiver/s in-between two sessions. This structure shall continue to perform until all the sessions for that program are furnished and delivered. Also that the receiver understands, agrees and accepts that the provider guides information, assessments and educational/career-development services (Programs and courses) and that the provider does not guarantee, admission, marks, examination results, scholarships, employment, income, specific career success, overseas admission, university acceptance, a particular career outcome, improvement in academic performance or anything that the Receiver is intending or targeting for. The Receiver will not be expecting, forcing, targeting to get their Career/ course/ stream decisions from the provider, rather through these services guided by the provider the Receiver will specifically make these decisions for themselves. If the receiver is a Minor then the same decision is expected to be made by the adult (parent or a guardian) of that minor receiving these services.
For Skill-Build:
Skill-build as a section is planned by the Provider to guide personal & professional skill development courses that are prerecorded in nature and will only be available to be viewed on the https://www.svastrino.com/ website only. This is where the Receiver/s would enrol for the courses launched or that are live and visible in the Skill-Build page by paying for their preferred course/s and the payment plan and then continue to do those courses as planned by the Provider. The course will be guided in 3 stages. First the Receiver/s will have to watch a video to understand the core topic of the week. This video will be for max 30 minutes. Second, they have to download the pdf that will unlock as the initial video is watched totally. This PDF will help students reflect on their life & career and build a bridge between the video and the daily development tasks. Third, they will have to do tasks for the rest 6 days of the week that will be planned to help the Receiver/s apply the ideas learnt and realised from the weekly video. Each Receiver will have to follow the three stage process for the specific course duration so as to complete the course in the right way as planned by the provider. The videos guided in the first stage are only downloadable on the server and not on the device of the user which helps the user to save space on their devices. Receiver/s will have to make sure that they do the courses as per the timelines guided by the Provider. When any Receiver/s enrols for any skill-build course they will become a temporary user of the website. They can view the daily course content as planned and further can also do the tasks/ exercise as guided by the Providers for each course. Doing the same the Receiver/s will have to complete the course they would have registered for. Not completing the course for a certain period will lead to disabling the account and the Receiver/s will have to get in touch with the backend team to get the same enabled by providing a valid reason through which the team can enable the account. The Skill-Build courses are planned in a way that the students can do them at their own pace and length and so there is no attendance for the course to be done. The current Skill-Build course that is launched on the website is called ‘Nirmaan’ with a Tag line ‘Soch Se Vikas’ This Course is technically called the Service as per this contact. It is a 24 week course which receiver/s have to do daily so as to complete this service in a total of 163 days in continuation. Each receiver can complete this Nirmaan course in a maximum period of 365 days from the first day of their login on the Providers Website. If the Receiver/s stops using the course or does not complete the course in the above guided timelines then the user account of that specific receiver will be restricted. If the Receiver plans to restart the course then they will have to get in touch with the back office team of the provider, provide a valid reason for the delay of the course, after which the back office team of the provider will decide to reinstate the user account of the receiver or not.
For Psychometric Testing:
‘Psychometric Testing’ is a scientific testing that helps individuals to understand their interests, preferences, aptitudes, personality, strengths and drawbacks so as to explore the related career options and plan their journey going ahead. The inclusion of Psychometric Testing is with the intention to help the Receiver/s to understand their preferences, interests and drawbacks so as to explore the related career options accordingly. This test can be taken by 2 separate groups of school going students. One from the standard of 7th to 9th and other from 10th to 12th. The 1st test is for students who would want to find the stream of further education and the 2nd test is for students who would want to find the specific course/ career study option that they could pick after their current grade of study. Registered Receiver/s have to take the test in the timelines guided on the test page. Post which the specific receiver will get a test report of minimum 27 pages and max up to 40 pages depending on the test opted for by the Receiver. The test report will guide a detailed description on various Career Assessment Frameworks ‘Orientation Style, Personality, Interests, Aptitude and Emotional Quotient’. The test report will also guide details on various parameters and traits of each of the Career Assessment Frameworks. Further the test report will guide the Receiver their Dominant style that is evolved through the above discoveries. Finally the Test report will guide top 5 career options/ courses that match your overall outcomes of the Career Assessment Framework. With these top 5 career options/ courses, you will also get details on the reason why this test finds you the best fit for those 5 career options. And then that will be followed by Top 10 skills needed to enter that career/ course, Trending jobs in the domain of that career/ course, Institutes/ universities in India and abroad offering that specific program, Common entrance exams for that career/ course. In short, the test report provides structured insights that may assist students, parents and counsellors in exploring suitable educational and career directions. By registering for the psychometric test the Receiver understands, agrees and accepts that the results of this test can vary, differ, change, or can be different then expected due to the factors listed below. The test verification, calculation and the report creation is majorly based on information supplied by the receiver who is taking the test, with the idea if the receiver has completed the test successfully and that all questions are completed and submitted particularly, that the Receiver was sincere throughout the test and did take the test by providing honest and transparent answers to every question that was asked on the test, that the assessment methodology may have its own limitations and hurdles to verify some information that the student may have provided, that the age and/ or current personal, physical, societal, emotional and psychological stage of student is apt to take the test, and finally the context by which the Receiver (Major or Minor by age) gives the test is similar to the context on which the test is created to track, verify, calculate and then create the report.
Combination Package:
Receiver/s can book the Skill-Build course or the Psychometric test separately or as a package as guided in their individual service page.
These above services (Programs, Courses or Informations) are only intended to be used by one Receiver at a time and so that service or user account cannot be transferred to any other Receiver who is a prospect anytime during when the service is active or inactive or blocked.
Also that the receiver understands, agrees and accepts that the provider guides information, assessments and educational/career-development services (Programs and courses) and that the provider does not guarantee, admission, marks, examination results, scholarships, employment, income, specific career success, overseas admission, university acceptance, a particular career outcome, improvement in academic performance or anything that the Receiver is intending or targeting for. There are other pages on the website that display information about various careers that are known as Career Library, a page dedicated to General Blogs, a page that can help a Receiver/s to check all FAQs of the total website and a page called Success Stories where the Receiver/s can read testimonies of all the past students and some of the students parents. Information on the website may be provided for knowledge, educational and informational purposes and may change over time. Receiver/s should independently verify eligibility, admission requirements, fees, deadlines, examination rules, scholarships and other requirements with the relevant official authority (University, Colleges, Examining authorities, Schools, Institutions, Education authorities and nation wide education bodies, etc.) before making any decision for their career or future journey. The Provider is just presenting this information to bridge the gap between the students and the various bodies from where the Provider is sourcing the information. The Receiver/s also agrees to understand and accept that they shall not copy, store any information given on the website as a process of counterfeit.
Contact Page
Contact page is a page that allows a Receiver/s to get in touch with the Provider through Call, Email, Physical Meets, Social Media and a Contact Form that allows Receiver/s to send their query to us through a form and then the Provider will get in touch with the Receiver/s through the contact details guided by the Receiver/s.
Understanding the Nature of the Services
The Receiver/s understands, agrees and accepts that the Provider provides information, assessments, counselling, guidance, mentoring and educational and career-development services, including Programs and Courses, for the purpose of supporting the Receiver/s in understanding themselves, exploring available options, developing relevant skills, evaluating alternatives and making more informed personal, educational and/or career-related decisions.
The Services are intended to provide guidance, information, assessment-based insights, perspectives, approaches, recommendations and developmental support. The Services are not intended to replace the independent judgment, responsibility or decision-making of the Receiver/s and/or their parent or lawful guardian, as applicable.
Responsibility of the Receiver/s
The Receiver/s shall be responsible for actively participating in the Services, providing relevant and reasonably accurate information, completing applicable activities or assessments, considering the guidance provided, evaluating available alternatives and taking responsibility for the decisions and actions they ultimately choose to undertake.
The Receiver/s understands that the Provider can guide, inform, assess, mentor and present possible options, but the Provider cannot make the Receiver/s' future decisions on their behalf.
The Receiver/s shall therefore use the information and guidance received from the Provider as one part of their decision-making process and shall independently consider their own interests, abilities, circumstances, preferences, eligibility, resources, requirements and other relevant factors before taking any decision.
No Guarantee of Results or Outcomes
The Receiver/s understands, agrees and accepts that the Provider does not guarantee, promise or represent that the Services will result in any particular outcome.
Without limiting the generality of the foregoing, the Provider does not guarantee or promise:
- admission to any school, college, university or other educational institution;
- acceptance by any university or educational institution in India or overseas;
- any particular marks, grades, examination results or academic performance;
- improvement in academic performance;
- scholarships, grants, financial assistance or other forms of educational funding;
- employment, internships, placements or selection by any employer or organisation;
- any particular income, salary, earning capacity or financial outcome;
- success in any particular career, profession, business or occupation;
- selection for any particular course, programme, institution, examination or opportunity;
- achievement of any particular career objective or personal objective;
- selection of any particular stream, subject, course, college, university or career;
- achievement of any particular level of personal, educational or professional development; or
- any other specific result, achievement or outcome that the Receiver/s may intend, expect, seek, target or desire.
Any guidance, recommendation, assessment result, discussion, example, possible pathway or opinion provided by the Provider shall not be interpreted as a guarantee that the Receiver/s will achieve a particular result.
No Guaranteed Career, Course or Stream Decision
The Receiver/s understands and agrees that the purpose of the Services is to support the Receiver/s in making their own informed decisions, and not to obtain a predetermined decision from the Provider.
The Receiver/s shall not expect, require, compel or treat the Provider as being responsible for deciding on their behalf:
- which career they must pursue;
- which course they must choose;
- which stream or subject combination they must select;
- which institution or university they must attend;
- which profession they must enter; or
- which specific educational or professional pathway they must follow.
The Provider may, based on the nature of the Service, provide assessments, observations, recommendations, possible options, comparative information, guidance and professional perspectives. However, such guidance shall not constitute an instruction or legally binding determination that the Receiver/s must follow a particular career, course, stream, institution or pathway.
Independent Evaluation of Guidance
The Receiver/s shall evaluate the information and guidance provided by the Provider in the context of their own circumstances before taking any decision.
The Receiver/s understands that educational and career decisions may involve several factors, including but not limited to academic performance, interests, abilities, skills, personality, financial circumstances, eligibility requirements, location, family circumstances, institutional requirements, changing employment conditions, competition and future opportunities.
Accordingly, the Receiver/s shall not interpret any individual assessment, recommendation, counselling session, course module or other Service as being sufficient, by itself, to determine every aspect of their future.
Responsibility for Information Provided by the Receiver/s
The Receiver/s shall provide information that is reasonably accurate, complete and relevant for the purpose of the Service.
Where the Provider relies upon information supplied by the Receiver/s for counselling, assessment, mentoring, recommendations, personalised guidance or other Services, the Receiver/s acknowledges that inaccurate, incomplete, misleading, outdated or withheld information may affect the relevance or usefulness of the Service.
The Provider shall not be responsible for an outcome arising from information that was materially inaccurate, incomplete, misleading, outdated or withheld by the Receiver/s.
Assessment Results and Professional Guidance
Where the Services include psychometric tests, assessments, questionnaires, competency evaluations or other assessment tools, the Receiver/s understands that the resulting report, score, profile or interpretation is intended to provide information and insights for developmental and/or decision-support purposes.
Assessment results shall not be treated as an absolute or permanent determination of the Receiver/s' abilities, personality, potential, suitability, future performance or career outcome.
Similarly, any interpretation or guidance provided by the Provider based on an assessment shall be considered within the scope and limitations of that assessment and the information available to the Provider at the relevant time.
The Receiver/s shall not treat an assessment result as an unconditional guarantee that a particular career, course, stream, institution or profession will be suitable or successful for them.
Educational and Career Decisions
The Receiver/s acknowledges that educational and career decisions may have significant long-term consequences and should therefore be considered carefully.
The Provider may assist the Receiver/s in understanding and evaluating available choices; however, the Provider does not assume responsibility for the final choice made by the Receiver/s.
The Receiver/s shall remain responsible for verifying, wherever appropriate, current eligibility requirements, admission criteria, examination requirements, fees, institutional policies, scholarship conditions, application deadlines, employment requirements and other conditions applicable to any specific opportunity they choose to pursue.
Third-Party Decisions and External Circumstances
The Receiver/s understands that several outcomes relating to education, examinations, admissions, scholarships, employment and careers are determined wholly or partly by third parties or by circumstances outside the Provider's control.
These may include decisions or requirements of schools, colleges, universities, examination bodies, employers, government authorities, scholarship providers, professional bodies, regulatory authorities and other organisations.
The Provider does not control such decisions and does not guarantee that any third party will accept, select, admit, employ, fund or otherwise provide an opportunity to the Receiver/s.
Responsibility Where the Receiver/s Is a Minor
Where the Receiver/s is a Minor, the parent or lawful guardian of such Minor shall have the responsibility for participating in and/or supervising the decision-making process relating to the Minor's education, career and other significant personal or professional choices, to the extent required by applicable law and the nature of the decision.
The Services may provide the Minor with information, assessments, guidance, mentoring and opportunities to understand themselves and explore educational and career possibilities. However, the Provider does not assume the role of the parent or lawful guardian and shall not be responsible for making parental, guardianship or final educational/career decisions on behalf of the Minor.
Where a decision relating to the Minor's education, course, stream, institution, career or other significant pathway requires an adult decision, the parent or lawful guardian shall remain responsible for making or approving that decision, as applicable.
No Transfer of Decision-Making Responsibility to the Provider
The Receiver/s and, where applicable, the parent or lawful guardian, shall not transfer their responsibility for making educational, career or personal decisions to the Provider merely because the Provider has provided counselling, mentoring, assessment or guidance.
The Provider's involvement in the decision-making process is limited to providing the Services described on the Website and does not create a relationship in which the Provider becomes the decision-maker for the Receiver/s.
No Expectation of a Particular Recommendation
The Receiver/s understands that the outcome of a counselling session, assessment, mentoring programme or other Service may not be the outcome that the Receiver/s initially expected or desired.
The Provider may present alternatives, identify areas requiring further exploration, question an existing assumption, recommend consideration of different options or determine that additional information is required before a meaningful recommendation can be made.
The Receiver/s agrees to understand such guidance as part of the developmental and decision-support nature of the Services and shall not require the Provider to provide a particular recommendation merely because that recommendation is preferred by the Receiver/s.
Responsibility for Action After Receiving Guidance
The Provider's responsibility is limited to delivering the Services that have been booked or purchased in accordance with their stated scope.
Once guidance, assessment information, recommendations or other Services have been provided, any subsequent action or decision taken by the Receiver/s and/or their parent or lawful guardian shall remain their responsibility.
The Provider shall not be responsible for the consequences of a decision made by the Receiver/s and/or their parent or lawful guardian after considering, accepting, rejecting, modifying or disregarding the guidance provided.
Acknowledgement by the Receiver/s
By booking, purchasing, accessing or participating in any Service, Program or Course through the Website, the Receiver/s confirms that they understand and accept that:
- the Provider's role is to provide information, assessment, counselling, guidance, mentoring and educational/career-development support;
- the Provider does not guarantee a particular educational, academic, career, employment, financial or personal outcome;
- the Provider does not guarantee admission, university acceptance, examination results, marks, scholarships, employment, income or specific career success;
- the Provider does not guarantee improvement in academic performance or achievement of any particular target of the Receiver/s;
- the Provider does not make the final career, course, stream or educational decision on behalf of the Receiver/s;
- the purpose of the Services is to assist the Receiver/s in understanding and evaluating options so that the Receiver/s can make more informed decisions;
- where the Receiver/s is a Minor, the parent or lawful guardian remains responsible for the Minor's final decisions to the extent applicable; and
- The ultimate responsibility for decisions and actions taken after receiving the Services remains with the Receiver/s and/or their parent or lawful guardian, as applicable.
Bookings, Online Appointments & Service Delivery For Programs
Nature of Services and Online Booking
The Provider is engaged in providing life and career counselling and mentoring services. The services offered by the Provider through this Website may include, as applicable, career counselling sessions, mentoring sessions, guidance sessions, consultations and other related services or programmes made available by the Provider from time to time.
Unless otherwise expressly stated on the Website, bookings for the Services made available through the Website shall be initiated and completed through the online booking mechanism provided on the Website.
The Receiver/s shall be responsible for reviewing the description, scope, duration, applicable charges, available date and time slots, eligibility requirements, and other relevant information relating to the selected Service before proceeding with the booking.
Review and Acceptance Before Booking
Before making any booking or payment through the Website, the Receiver/s shall read and understand:
- these Terms and Conditions;
- the Privacy Policy; and
- the Cancellation, Rescheduling and Refund Policy,
as applicable to the Service being booked.
By proceeding with the booking and making payment, the Receiver/s confirms that they have read, understood and accepted the applicable terms and policies (Privacy, Rescheduling, Cancellations and Refunds) available on the Website and agrees to be bound by them without any condition.
The Receiver/s shall not proceed with the booking if they do not agree with any part of the applicable terms or policies. The Receiver/s shall not be permitted to modify, alter or impose any separate terms upon the Provider as a condition of booking or receiving the Service.
Booking Confirmation
A booking shall be considered confirmed only after the applicable payment has been successfully received and the booking has been confirmed through the Provider's Website, booking system, payment system or other official communication channel.
A payment transaction that is pending, failed, reversed, disputed or otherwise not confirmed shall not by itself constitute a confirmed booking.
The Receiver/s shall provide accurate and complete information required for the booking, including their name, contact details, email address and any other information reasonably required by the Provider for delivering the Service.
The Provider shall not be responsible for any communication failure, missed appointment or other inconvenience arising from incorrect, incomplete or outdated information provided by the Receiver/s.
Appointment Date, Time and Duration
Each Service shall be provided for the duration specified on the relevant booking page, package description, appointment confirmation or other official communication issued by the Provider.
The Receiver/s acknowledges and agrees that the booked appointment is time-bound.
The Service shall commence at or around the scheduled appointment time and shall ordinarily conclude upon expiry of the booked duration. The expiry of the scheduled duration shall apply irrespective of whether the Receiver/s has additional questions, concerns, discussions or queries remaining at that time.
The Provider shall not be under any obligation to extend a session beyond the booked duration without additional payment or prior approval from the Provider.
Extension of Session
Where the Receiver/s wishes to continue a session beyond the originally booked duration, any additional time shall be treated as an additional Service and shall be subject to availability and applicable charges.
An extension shall be provided only after the Receiver/s agrees to and makes the required advance payment for the additional period, unless the Provider expressly agrees otherwise in writing.
The Provider shall not be obligated to extend a session merely because the Receiver/s has unresolved or unanswered queries at the end of the booked period.
Any extension shall remain subject to the Provider's availability and shall not automatically be available merely because the Provider's schedule permits additional time.
Provider Availability and Change in Appointment
The availability displayed on the Website or booking calendar is intended to represent the appointment slots made available for booking by the Provider.
In exceptional circumstances, the Provider may become unavailable due to personal commitments, professional obligations, emergencies, technical issues, unforeseen circumstances or other reasons, including circumstances that may not have been reflected on the online calendar at the time of booking.
In such circumstances, the Provider reserves the right to:
- postpone or reschedule the appointment;
- offer an alternative date or time slot;
- continue or complete the Service at another mutually convenient time; or
- take such other reasonable action as may be necessary to provide the booked Service.
The Provider shall make reasonable efforts to inform the Receiver/s of any such change as soon as reasonably practicable and, wherever possible, offer an alternative appointment slot.
Where the Provider is unable to provide the booked Service and no mutually acceptable alternative can be arranged, the Receiver/s shall be entitled to the remedy applicable under the Provider's Cancellation, Rescheduling and Refund Policy.
Delay by Receiver/s
The Receiver/s is expected to be available at the scheduled date and time of the appointment at least 10 minutes before the session is about to start.
Where the Receiver/s joins the appointment late, the Provider may continue the Service only for the remaining portion of the originally booked duration. The Provider shall not ordinarily be required to extend the appointment beyond the originally scheduled end time solely because the Receiver/s joined late.
Any exception to this provision shall be entirely at the discretion of the Provider and subject to the Provider's availability.
Where the Receiver/s fails to attend the appointment altogether, the booking shall be treated in accordance with the applicable No-Show, Cancellation and Refund provisions of the Provider's Cancellation, Rescheduling and Refund Policy.
Nature of Counselling, Guidance and Mentoring
The Receiver/s understands and agrees that the Services provided by the Provider are intended to provide professional guidance, counselling, mentoring, perspectives, approaches, information and/or recommendations based on the information made available by the Receiver/s and the nature of the Service booked.
The Services are intended to assist the Receiver/s in understanding and evaluating available options and making more informed personal, educational and/or career-related decisions.
The Services do not constitute an instruction that the Receiver/s must follow a particular educational, professional, academic, employment, financial, personal or career path.
Responsibility for Decisions
The Receiver/s shall retain complete responsibility for any decision taken by them after receiving the Services.
Any decision relating to education, academic courses, institutions, examinations, career choices, employment, profession, business, relocation, financial commitments, personal development or any other aspect of the Receiver/s' future shall ultimately be made by the Receiver/s and/or their parent or legal guardian, as applicable.
The Provider (its counsellors, mentors, employees, consultants or representatives) shall not be required to make the final decision on behalf of the Receiver/s.
The Receiver/s acknowledges that counselling, mentoring and guidance are intended to support decision-making and do not transfer the responsibility or consequences of such decisions to the Provider.
No Obligation to Decide on Behalf of Receiver/s
The Receiver/s shall not require, compel or expect the Provider or any of its counsellors, mentors, employees, consultants or representatives to make a final personal, educational or career decision on their behalf.
The Provider may provide its professional observations, recommendations, possible approaches, alternatives and perspectives based on the information available during the Service. However, the Provider shall not be legally or contractually obligated to select, approve or guarantee a particular decision, course, institution, career, profession, employment opportunity or future outcome for the Receiver/s.
Accuracy and Completeness of Information Provided by Receiver/s
The quality and relevance of counselling, guidance or mentoring may depend upon the accuracy, completeness and relevance of the information provided by the Receiver/s.
The Receiver/s shall make reasonable efforts to provide truthful, complete, honest, transparent and relevant information during the booking process and during the Service.
The Provider shall not be responsible for any recommendation, assessment, guidance or outcome that is materially affected by inaccurate, incomplete, misleading, outdated or withheld information provided by the Receiver/s or by information that was not reasonably available to the Provider.
No Guarantee of Particular Outcome
The Receiver/s understands that counselling, mentoring and guidance services cannot guarantee a particular educational, academic, career, professional, employment, financial or personal outcome.
The Provider does not guarantee that the Receiver/s will obtain admission to any particular institution, secure any particular employment or career opportunity, achieve any particular academic result, obtain any scholarship or achieve any specific level of personal or professional success as a result of receiving the Services.
Any examples, illustrations, opinions, possibilities, recommendations or potential pathways discussed during a Service shall not be interpreted as a promise or guarantee of a future result.
Third-Party Decisions and External Factors
The Receiver/s acknowledges that many educational and career-related outcomes depend upon factors outside the control of the Provider, including but not limited to admission requirements, examination results, academic performance, eligibility criteria, institutional decisions, employer decisions, competition, market conditions, availability of opportunities, government or regulatory requirements, financial circumstances and decisions of third parties.
The Provider shall not be responsible for decisions or actions taken by educational institutions, universities, employers, government authorities, examination bodies, financial institutions or other third parties.
Parent/ Guardian Involvement Where Receiver Is a Minor
Where the specific Receiver is below the applicable age of legal majority [18], the booking and use of the Service shall be undertaken with the involvement, consent and responsibility of the Receiver/s' parent or lawful guardian, wherever required by applicable law or by the Provider's applicable process.
The parent or lawful guardian shall be responsible for ensuring that the minor Receiver/s understands the nature of the Service and participates appropriately.
Nothing in the Services shall be interpreted as transferring parental or guardianship responsibility to the Provider.
Communication Relating to Bookings
The Provider may communicate with the Receiver/s through the registered email address, telephone number, Website account, messaging system or other contact details provided during the booking process for purposes including:
- booking confirmation;
- appointment reminders;
- appointment changes;
- payment confirmation;
- invoices and receipts;
- rescheduling;
- cancellation;
- service-related instructions; and
- other communications necessary for delivering or administering the booked Service.
Such communications may be sent irrespective of whether the Receiver/s has separately opted out of promotional or marketing communications, where the communication is necessary for the performance or administration of the booked Service.
Acceptance of Service Process
By completing a booking and making payment, the Receiver/s confirms that they understand and accept the process governing the booked Service, including its scheduled duration, appointment requirements, payment requirements, applicable cancellation/rescheduling/refund provisions, and the nature and limitations of counselling, guidance and mentoring described in these Terms and Conditions.
The Receiver/s further acknowledges that the Provider's role is to provide guidance, counselling, mentoring, information and professional perspectives and that the ultimate responsibility for decisions and actions remains with the Receiver/s and/or their parent or lawful guardian, as applicable.
Payments, Pricing, Taxes, Invoicing & Promotional Offers
Prices Displayed on the Website
The prices displayed on the relevant service, (program, course, assessment) or other paid offering page and at the checkout/ payment page shall be the applicable price presented to the Receiver at the time of purchase.
At the current stage of operation, the prices displayed on the website are inclusive of applicable taxes, wherever stated on the relevant checkout page. If the applicable tax structure, tax registration status, tax rate, tax applicability or any other statutory requirement changes in the future, the Provider reserves the right to modify the prices displayed on the website so as to include or separately charge the applicable taxes and statutory levies, as may be required under applicable law.
The price applicable to a particular transaction shall be the price displayed and accepted by the Receiver at the time the transaction is successfully completed, subject to any applicable promotional offer, discount or other pricing condition expressly displayed at the time of purchase.
Payment Gateway
The Provider currently uses Cashfree Payments as its payment gateway/ service provider for processing online payments.
The Receiver may be required to complete the payment through the payment options made available through the payment gateway at the time of purchase. The availability of any particular payment method may depend upon the payment gateway, banking network, payment service provider or other applicable technical or operational factors.
A payment shall be considered successfully received only when the transaction has been successfully processed and the payment status has been confirmed through the relevant payment gateway/ system.
Upon successful confirmation of payment, the Receiver shall receive a payment confirmation or transaction-related communication at the registered email address or through another communication channel associated with the transaction, wherever such communication is supported by the Provider or its payment service provider.
Payment Failure or Incomplete Transaction
A payment transaction may fail, remain pending, be interrupted or not be successfully recorded due to reasons including, but not limited to, network interruptions, banking issues, payment gateway issues, server errors, technical failures, connectivity problems, incorrect transaction information or other circumstances beyond the immediate control of the Provider.
If a payment fails or remains incomplete, the Receiver should first allow reasonable time for the payment status to be updated before attempting the transaction again. The Receiver should avoid making repeated payments while the status of an earlier transaction remains unclear, as this may result in a duplicate transaction.
If an amount has been debited from the Receiver's bank account or payment method but the corresponding payment is not reflected as successfully received by the Provider, the Receiver may contact the Provider with the relevant transaction details so that the transaction status can be verified with the payment gateway or applicable payment service provider.
The Provider shall not treat a Service (program, course or assessment) as successfully booked or enrolled merely because an amount appears to have been debited from the Receiver's account. Access or enrolment shall be confirmed only after successful verification of the applicable payment transaction.
Duplicate Payments
If the Receiver makes more than one successful payment for the same service for the same Receiver, program, course or assessment due to a duplicate transaction, the Provider shall verify the transaction with the relevant payment gateway and/or payment records.
Once the duplicate payment is confirmed as successfully received and identified as an additional payment for the same transaction, the additional duplicate amount shall be eligible for refund to the Receiver.
The refund of a confirmed duplicate payment shall be initiated within a maximum period of 14 working days from the date on which the duplicate transaction is verified and confirmed by the Provider and/or the relevant payment gateway, subject to the operational processing time of the applicable banking or payment system.
Where necessary, the Provider may request transaction-related information from the Receiver solely for the purpose of identifying and reconciling the duplicate payment. The Receiver shall not be required to share complete payment-card numbers, passwords, PINs, OTPs or other confidential payment credentials with the Provider.
Invoice and Payment Record
After successful receipt and confirmation of payment, the Provider shall issue or make available an invoice or payment receipt for the relevant Service (program, course or assessment) or other paid offering, as applicable.
The invoice shall ordinarily be sent to the registered email address provided by the Receiver during the booking, enrollment or purchase process, or may be made available through the Receiver's account/dashboard where such functionality is provided.
The Receiver is responsible for providing accurate billing and contact information at the time of purchase. Any request for correction of an invoice or billing information should be communicated to the Provider within a reasonable period after receipt of the invoice.
Pricing Changes
The prices of services, programs, courses, assessments and other paid offerings available through the Provider may change from time to time.
The Provider reserves the right to introduce, increase, decrease, revise, withdraw or otherwise modify the price of any offering at its discretion, subject to applicable law.
Any price change shall apply prospectively to future purchases and shall not ordinarily alter the price of an order or enrolment that has already been successfully completed and confirmed, except where a correction is required due to an obvious pricing or technical error or where otherwise permitted or required by applicable law.
Promotional Pricing and Discounts
The Provider may, from time to time, introduce promotional prices, discounts, limited-period offers, introductory offers, special offers or other pricing benefits for selected services, programs, courses, assessments or other offerings.
Such promotional offers may be:
- available for a specified period;
- limited to a specified number of Receivers;
- limited to particular services, programs or courses;
- available only to specified categories of Receivers;
- subject to additional eligibility or usage conditions; or
- subject to any other conditions expressly communicated at the time of the offer.
The Provider reserves the right to introduce, modify, extend, limit, suspend or withdraw any promotional pricing or discount offer at its discretion, subject to applicable law and the specific terms communicated for that offer.
Unless expressly stated otherwise, one promotional offer shall not automatically be combined with another offer, discount or pricing benefit.
A promotional price shall not create any entitlement to receive the same price for future purchases after the relevant promotional period or eligibility condition has ended. The renewal of the same service shall be on the original price and not on the promotional price that the receiver may receive in the start when registering for that specific service.
Institutional and Bulk Pricing
The prices applicable to institutional, school, college, academy, organisation, NGO, CSR, community or other bulk purchases may differ from the prices applicable to individual Receivers purchasing a Service (program, course or assessment) through the public website.
Institutional or bulk pricing may be determined separately based on factors including the number of participants, nature of the engagement, services included, duration, delivery arrangement and other commercial terms applicable to the specific engagement.
Receivers seeking institutional or bulk enrolment may obtain the applicable pricing and commercial terms by contacting the Provider's authorised representative or online sales team.
Any institutional or bulk arrangement shall be governed by the specific commercial terms communicated and accepted for that engagement, in addition to these Terms wherever applicable.
Scholarships and Sponsored Support
The Provider may, from time to time, offer scholarship support or sponsored access to a limited number of eligible or deserving Receivers, students or candidates, as determined by the Provider.
Such scholarship or support may, depending upon the particular initiative, take one or more of the following forms:
- full or partial waiver of the applicable Service (program, course or assessment) fee;
- complimentary access to a Service (program, course or assessment);
- financial assistance or a cash award;
- partial financial assistance combined with complimentary access; or
- any other form of support determined by the Provider for the relevant scholarship initiative.
Scholarships are discretionary and shall be subject to the eligibility criteria, availability, terms and conditions applicable to the specific scholarship initiative, where such criteria or conditions are published or communicated.
The Provider reserves the right to determine the number of scholarships, the value and form of support, the eligibility requirements, the selection process and the recipients of scholarship support for each initiative, subject to applicable law.
Unless expressly stated otherwise for a particular scholarship initiative, participation in or application for a scholarship does not create any automatic entitlement to receive financial assistance, free access or any other benefit.
The Provider may discontinue, modify or introduce scholarship initiatives from time to time. A scholarship granted to a particular Receiver shall be subject to the terms communicated at the time of grant.
Scholarship support, where granted, shall not ordinarily be transferable to another receiver, exchanged for cash or converted into another service or benefit unless expressly permitted by the Provider.
Payment Records and Transaction Verification
The Provider may maintain transaction records relating to payments, invoices, refunds, cancellations, promotional offers and other financial transactions for accounting, reconciliation, customer support, legal, regulatory and business record-keeping purposes.
Where there is a discrepancy between the payment status shown by the Receiver's bank/payment method and the payment status recorded by the Provider, the Provider may verify the transaction with the relevant payment gateway, banking institution or payment service provider before confirming the status of the transaction, access, enrolment or refund.
Payment-Related Communication
The Provider may communicate with the Receiver regarding payment-related matters, including payment confirmation, unsuccessful or pending transactions, invoices, refunds, duplicate payments, payment reconciliation, account-related charges and other matters necessary to complete or administer the transaction.
Such communications are considered service-related communications and may be sent to the registered email address, mobile number or other contact information provided by the Receiver.
Taxes and Statutory Charges
Where any tax, levy, cess, fee or other statutory charge becomes applicable to a transaction under applicable law, the Provider may collect or recover the same from the Receiver in accordance with the applicable legal requirements.
The applicable tax treatment shall be determined based on the law, tax registration status and nature of the relevant transaction at the time the transaction is made.
The Receiver shall be responsible for reviewing the final amount displayed at checkout before completing the payment.
Users Account:
The user's account page is for those Receiver/s who have booked a service (Program and/or Course) through the website of the Provider as guided in the Book Online Section above. Each Receiver is requested to register via single login details. This is where the Receiver/s will be able to track all details of their Profile or Services they would’ve enrolled with the Provider. The Receiver/s will get a unique username through which all their personal details, and service details can be tracked and updated. The password of the Receiver stays secure to a level that the Provider doesn’t have the access to view it at any point of time. Receiver/s can change the password of their user account as and when needed. We highly insist to the individual Receiver to not share their Login Credentials (Email ID, Password, Username, Contact Number) or to not share the logged in user page of this website with anyone else, outsider, people they know or don't know as that could lead to multiple use of the account, or hacking of content or wrong answering on the website on behalf of the original Receiver which isn’t allowed as per our terms of use. The Dashboard will guide Service details (For Programs- Slot/ Appointment Details, Session Updates and Tasks that the Receiver is expected to do after the session is completed. For Course- The Receiver will be able to see the Skill-Build Course they would’ve selected and their journey of course completed till date) In the course section the Receiver/s will be guided the Weekly Video > Downloadable PDF and then the daily task, which when completed will unlock the next weeks process in the same way. Receiver/s can guide answers to the tasks that will have to be done to complete that level and move to the next one. To be a User of this website the Receiver/s has to enrol/ register and pay for any Service and then register themselves with their personal email ID and mobile phone number. Post that the Receiver/s shall become a registered user of the website and will have the access for this User Area to be accessed. The Receiver/s agrees to understand and accept that they shall use all the features of the User’s page to get information on various courses that are provided by the Provider. The Receiver understands, agrees and accepts that they will personally take total responsibility for any activity that happens on their User account. The Receiver will have to make sure that no one is using their account other than the original Receiver who has registered for the account. If the receiver is a minor, then it is legally expected that an adult (Parent or Guardian) is monitoring each and every activity of the registered receiver. Any activity that the minor receiver does will be considered as an activity verified and updated on the website by the adult (Parent or Guardian) of the minor. If the Receiver notices any suspected or unauthorised access on their User Account, then the same has to be notified to the Provider immediately through mail guiding all specific details (Images, Videos and message) of that suspected or unauthorised activity on that account. If any unauthorised, illegal activity or activity beyond permissible limitations is found to be done by any receiver through their account then in that case the User account of that specific Receiver will be suspended and restricted immediately. The Provider [Svastrino Consultancy Services] reserved the right to suspend, restrict and block that specific Receiver’s User Account without any prior notice and if that unauthorised, illegal activity or activity beyond permissible limitations is illegal then the same will also be guided for investigation under specific laws of the Republic of India.
Website Availability & Technology
Website Availability
The Provider shall make reasonable efforts to keep the Website and its Services available and operational through appropriate technical and operational practices. However, the Receiver/s understands and accepts that continuous, uninterrupted or permanent availability of the Website cannot be guaranteed.
Maintenance, Updates & Technical Changes
The Website, its features, systems, content and technology may be modified, upgraded, maintained, suspended or discontinued from time to time due to maintenance, security requirements, technical upgrades, changes in technology, operational requirements or other circumstances. Such changes may temporarily affect the availability or functionality of the Website or any Service.
Errors & Technical Limitations
The Receiver/s understands and accepts that, as the Website operates through evolving technology and may depend upon third-party infrastructure, networks, software or services, the Website may occasionally contain errors, bugs, technical limitations, interruptions or delays. The Provider does not guarantee that the Website will always be completely error-free, uninterrupted, secure or compatible with every device, browser, network or technology.
Circumstances Beyond Provider's Control
The Provider shall not be responsible for temporary unavailability, interruption, delay, loss of functionality or technical failure caused by circumstances beyond its reasonable control, including internet or network failures, hosting or infrastructure issues, cyber incidents, third-party service failures, power failures, government or regulatory actions, natural events or other force majeure circumstances.
No Waiver of Service Obligations
Temporary Website or technology-related unavailability shall not, by itself, constitute a waiver or cancellation of the Receiver/s' contractual obligations or any applicable Service terms. Where reasonably possible, the Provider may take appropriate steps to restore affected Services or provide an alternative means of access.
Limitation Of Liability
Exclusion of Certain Damages
To the maximum extent permitted by applicable law, the Provider, Svastrino Consultancy Services, its directors, employees, team members, consultants, representatives and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, revenue, opportunity, goodwill, reputation, anticipated benefit, data or other intangible loss arising from or relating to the use of, or inability to use, the Website or Services.
Information & Service Limitations
To the maximum extent permitted by applicable law, the Provider shall not be responsible for losses arising from errors, omissions, inaccuracies, temporary unavailability, technical limitations or interruptions in Website content or Services, or from the Receiver/s' reliance upon information available through the Website or Services.
The Receiver/s acknowledges that educational, career and personal-development information is provided for guidance and developmental purposes and does not guarantee any particular academic, admission, career, employment, financial or other outcome.
Third-Party & Technical Risks
The Website and Services may depend upon third-party platforms, hosting providers, payment gateways, internet networks, communication services, software, tools or other technology. To the maximum extent permitted by applicable law, the Provider shall not be liable for losses arising solely from the failure, interruption, delay, unauthorised action or unavailability of such third-party services or infrastructure beyond the Provider's reasonable control.
Account, Device & Network Security
The Receiver/s is responsible for maintaining the security of their account credentials, devices, operating systems, applications, internet connection and network used to access the Website and Services. The Receiver/s should use trusted devices and networks, maintain appropriate security measures and avoid suspicious links, files, messages, websites or communications that may compromise their device or account.
The Provider shall not be responsible for a security incident or loss caused by the Receiver/s' failure to reasonably secure their account, device, credentials or network, or by actions originating from the Receiver/s' own device or connection.
Website Security & Personal Data
The Provider shall take reasonable technical and organisational measures required under applicable law to protect personal data and Website systems. However, no internet-based system can be guaranteed to be completely secure, and the Provider cannot guarantee that unauthorised access, cyberattacks, malware, data breaches or other security incidents will never occur.
Where a security or personal-data incident occurs, the Provider's responsibilities and the Receiver/s' rights shall be governed by applicable law and the Provider's applicable Privacy Policy and data-protection obligations. Nothing in these Terms shall exclude or restrict any liability or obligation that cannot lawfully be excluded or restricted.
Website Downtime & Service Interruption
The Provider shall make reasonable efforts to restore the Website or affected Services following technical failure, maintenance, security incidents or other interruptions. To the maximum extent permitted by applicable law, temporary downtime or interruption shall not, by itself, make the Provider liable for loss of time, opportunity, data, information, revenue or other indirect or consequential loss.
Limitation Preserved by Law
Nothing in this Clause shall exclude, restrict or limit liability for fraud, wilful misconduct, or any other liability that cannot legally be excluded or limited under applicable law. Where applicable law imposes a mandatory remedy, consumer right, data-protection obligation or other liability upon the Provider, such requirement shall prevail over this Clause to the extent of the inconsistency.
Promotions & Communications
Service & Promotional Communications The Receiver/s agrees that the Provider may communicate with them through the contact details provided by the Receiver/s, including phone calls, WhatsApp, SMS, email or other communication channels, for purposes related to the Website and Services.
Such communications may include Service-related notices, registration and enrolment information, payment or account updates, schedules, session reminders, important changes, feedback requests, customer support, new Services or Courses, offers, discounts, events, awareness initiatives and other promotional or marketing communications relating to the Provider.
Promotional Communication Preferences The Receiver/s may choose not to receive promotional or marketing communications by submitting an opt-out request to the Provider through the designated email or communication channel. Upon receiving such a request, the Provider shall take reasonable steps to remove the Receiver/s from the relevant promotional communication list.
Service-Related Communications
Opting out of promotional or marketing communications shall not prevent the Provider from sending communications that are necessary for the delivery, administration, security, support or completion of any Service already registered for or used by the Receiver/s, or communications that the Provider is required or permitted to send under applicable law.
Accuracy of Contact Details
The Receiver/s is responsible for providing accurate and updated contact information and for ensuring that the provided contact details remain accessible for receiving important Service-related communications. The Provider shall not be responsible for any communication failure arising from incorrect, outdated, inactive or inaccessible contact details provided by the Receiver/s.
Prohibited Activities & Restrictions On Use
The Receiver/s agrees to use the Website its Services (Programs, Skill-Build Courses, Psychometric Testing), content, information, communication facilities and other resources provided by the Provider only for their intended educational, personal-development and career-development purposes and in accordance with applicable laws of the Republic of India.
Unauthorised Access, Hacking & Misuse
The Receiver/s shall not hack, attempt to hack, bypass, interfere with, damage, disrupt, overload, spam, scrape, extract, access without authorisation, or otherwise misuse the Website, its systems, servers, databases, accounts, content, information or any technology used by the Provider. The Receiver/s shall not attempt to obtain unauthorised access to any other user's account, information or Services.
Unlawful or Inappropriate Content
The Receiver/s shall not upload, post, submit, transmit, communicate or otherwise make available through the Website or Services any content that is unlawful, false, misleading, fraudulent, defamatory, threatening, obscene, sexually explicit, abusive, harassing, hateful, discriminatory, invasive of privacy, or otherwise prohibited under applicable Indian law.
Cybercrime & Illegal Activities
The Receiver/s shall not use the Website or Services for committing, facilitating, attempting, encouraging or concealing any unlawful activity, cybercrime, fraud, impersonation, unauthorised access, data theft, identity misuse, malicious activity or any other activity prohibited under applicable laws of India, including applicable provisions of the Information Technology Act, 2000 and rules made thereunder.
Intellectual Property & Unauthorised Reproduction
All Website content and Service materials, including but not limited to videos, recordings, documents, PDFs, worksheets, tasks, assessments, questions, reports, course structures, session material, designs, graphics, text, processes, methodologies, trademarks, logos and other proprietary information, are provided for the Receiver/s' authorised personal use only. The Receiver/s shall not, without prior written permission of the Provider and except where expressly permitted by applicable law, copy, reproduce, duplicate, transcribe, record, download, publish, distribute, sell, license, modify, adapt, mimic, reverse engineer, commercially exploit or create derivative works from such material or use it to create or provide a competing service.
Unauthorised use or reproduction may constitute infringement of the Provider's intellectual-property rights and may result in appropriate civil or criminal action under applicable law, including the Copyright Act, 1957, where applicable.
Unauthorised Sharing of Services & Materials
The Receiver/s shall not share, forward, upload, circulate, distribute, disclose or otherwise provide access to any Service or its materials, including Program or Skill-Build Course details, videos, PDFs, tasks, worksheets, assessments, session details, recordings, updates, reports, links or other restricted information, to any person who is not an authorised Receiver/s of that Service neither during of after the course.
This restriction applies to sharing with friends, relatives, peers, classmates, batchmates, colleagues, acquaintances or any other person, whether such sharing is free of cost or for consideration.
Unauthorised Participants & Hidden Access
The Receiver/s shall not permit, invite, facilitate or conceal the participation of any unauthorised person in any Program, Course, session, webinar, assessment, meeting or other Service, including by sharing login credentials, access links, screens, recordings or other means. The Receiver/s shall not permit any person to attend a session as a hidden or undeclared participant, including any person who may be evaluating, accessing or attempting to obtain the Provider's Services or proprietary information without proper registration.
Misrepresentation & Misuse of Account
The Receiver/s shall provide accurate information wherever required and shall not impersonate another person, create or operate an account using false identity or information, misuse another person's account, share account credentials, or permit another person to use their account or Services.
Unrelated, Harmful or Prohibited Activities
The Website and Services are intended primarily for education, personal development, career development and related constructive discussions. The Receiver/s shall not use the Website or Services to promote, organise, facilitate or disseminate content or activities relating to terrorism, violent extremism, criminal activity, communal or religious hatred, political or ideological incitement, targeted harassment, hate speech, or any other unlawful or harmful activity.
The Provider may remove, restrict or refuse to publish any content that is unrelated to the purpose of the Website, harmful to other users, disruptive to the Services, or contrary to applicable law or the Provider's reasonable standards of use.
Consequences of Prohibited Activities
Where the Provider reasonably believes that a Receiver/s has engaged in any prohibited activity, the Provider may, depending upon the nature and seriousness of the conduct, remove or restrict the relevant content, suspend or restrict the account or access to the affected Service, terminate the Service or enrolment, refuse further access, and take appropriate civil, criminal or other legal action as permitted under applicable law.
Where required or considered appropriate, information relating to suspected unlawful activity may be reported or provided to the competent law-enforcement, cybercrime or other legal authorities in India.
Any such action by the Provider shall be without prejudice to any other rights or remedies available to the Provider under the applicable laws of India.
Educational & Constructive Use
The Receiver/s acknowledges that the Website and Services are intended to support constructive education, personal development and career development. The Receiver/s therefore agrees to use the Website, communication facilities and Services responsibly, respectfully and for their intended purpose, and shall not knowingly use them to disrupt, harm, mislead, exploit or negatively affect the Provider or any other Receiver/s.
Intellectual Property Rights
Ownership and Intellectual Property
All intellectual property made available through the Website by the Provider, including, as applicable, its original text, written content, course content, course names, course plans, course structures, tasks, assessments, methodologies, logos, trademarks, graphics, photographs, videos, audio, designs, presentations, documents, digital materials and other original materials (“Provider Content”), shall remain the property of the Provider or its respective licensors and shall be protected under applicable intellectual property laws.
Nothing in these Terms grants the Receiver/s any ownership, assignment or proprietary right in the Provider Content merely by visiting, accessing, purchasing, enrolling in or using any Service, Program or Course.
Permitted Use
The Receiver/s is granted a limited, personal and non-transferable right to access and use the Provider Content solely for the Service, Program or Course purchased or otherwise made available to them.
The Receiver/s shall not, without prior written permission of the Provider:
- copy, reproduce, duplicate or republish Provider Content;
- transcribe, record, download or redistribute Provider Content where such use is not expressly permitted;
- modify, adapt, mimic or create substantially similar versions of Provider Content;
- sell, licence, share, transfer or commercially exploit Provider Content;
- reproduce or use the Provider's course names, structures, tasks, methodologies, branding or other proprietary materials to create or promote a competing service; or
- remove, alter or conceal any copyright, trademark or other proprietary notices.
Protection of Course and Service Structure
The Receiver/s shall not reproduce, replicate or commercially exploit the Provider's distinctive course plans, course structures, learning frameworks, task structures, assessment formats, methodologies or combinations of materials for the purpose of creating, operating or promoting a substantially similar or competing service without the Provider's prior written permission.
This restriction applies whether such reproduction is carried out directly or through another person, organisation, platform or technology.
Provider Names, Logos and Trademarks
The Provider's name, logos, brand elements, course names, trademarks and other identifying marks may not be copied, altered, imitated or used in a manner that may cause confusion regarding ownership, affiliation, endorsement or association with the Provider.
Where a mark is registered, the applicable rights and protections under the Trade Marks Act, 1999 and other applicable laws shall apply.
No Unauthorised Commercial or Public Use
The Receiver/s shall not publish, distribute, display, upload, sell, licence, teach, reproduce or otherwise make Provider Content available to any third party or the public without the Provider's prior written permission.
This includes sharing paid course materials, videos, tasks, assessments, documents, recordings, presentations or other restricted materials through websites, social media, messaging platforms, file-sharing services or other digital or offline channels.
Intellectual Property Rights Reserved
All rights in Provider Content that are not expressly granted to the Receiver/s under these Terms are reserved by the Provider and/or the applicable rights holder.
Access to a Service, Program or Course does not constitute a transfer, assignment or licence of intellectual property rights beyond the limited use expressly permitted under these Terms.
Infringement and Enforcement
Where the Provider reasonably believes that the Receiver/s has copied, reproduced, distributed, misused, commercially exploited or otherwise infringed Provider Content or the Provider's intellectual property rights, the Provider may take appropriate action, including suspension or termination of the Receiver/s' access, removal of unauthorised content, issuing notices and pursuing civil, criminal or other remedies available under applicable law.
Nothing in this Section limits any rights or remedies available to the Provider under the Copyright Act, 1957, the Trade Marks Act, 1999 or other applicable intellectual property laws. The Copyright Act provides statutory remedies for infringement, including injunctions and damages, while the Trade Marks Act provides remedies including injunctions, damages or an account of profits in applicable cases.
Third-Party Intellectual Property
Where any content, material, software, image, trademark or other intellectual property made available through the Website belongs to a third party, such material shall remain subject to the rights of its respective owner or licensor.
The Receiver/s shall comply with any applicable restrictions relating to such third-party material.
Student Submissions, User Content & Promotional Use
Submission of Content
During the use of any Service, Program or Course, the Receiver/s may be required or permitted to submit information, answers, text, written work, voice notes, audio, photographs, videos, documents, responses, feedback, task submissions and other content through their User Profile, personal pages, Services or Courses (“User Content”).
The Receiver/s shall ensure that the User Content submitted by them is accurate, appropriate and lawful and that they have the necessary permission or rights to submit any content containing another person's information, image, voice or likeness.
Responsibility Before Submission
The Receiver/s understands that User Content submitted through the Website may become part of the Provider's records relating to the relevant Service, Program or Course.
The Receiver/s shall therefore review the content before submitting it and shall ensure that they are comfortable with the information, photographs, audio, videos and other content being submitted.
Where the Website or Course does not provide an option to edit or delete a particular submission after submission, the Receiver/s acknowledges that such submission may not be capable of being changed through the User Profile.
Rights to Use User Content
The Receiver/s grants the Provider a non-exclusive, worldwide, royalty-free right and licence to store, reproduce, process, analyse, adapt and use the User Content for the purposes of:
- providing and improving the Services, Programs and Courses;
- internal learning, research, analysis and development;
- developing educational materials, methodologies, products and services;
- creating anonymised or aggregated data, insights and reports; and
- operating, administering and improving the Provider's Website and digital platforms.
This licence shall continue for as long as reasonably required for the above purposes, subject to applicable law and the Provider's Privacy Policy.
Promotional and Marketing Use
Where the Receiver/s provides content that may identify the Receiver/s, including their name, photograph, voice, video, testimonial, feedback or identifiable experience, the Provider may use such content for promotional, marketing, educational or awareness purposes only where the Provider has obtained the consent required for such identifiable use.
Such use may include the Provider's Website, social media, digital media, search engine marketing, content marketing, email marketing, video marketing, online advertisements, presentations, workshops and other promotional channels used by the Provider.
The Provider shall not interpret the general submission of User Content as an unrestricted right to publicly publish identifiable personal information where separate consent is required by applicable law.
Use of Data and Information for Development
The Provider may use information and User Content generated through the use of its Services, Programs and Courses to understand participation, engagement, learning patterns, service effectiveness and areas for improvement.
The Provider may use anonymised or aggregated information for research, analysis, benchmarking, product development, educational content, business planning, marketing analysis and service improvement, provided that such information is not presented as identifying the Receiver/s where identification is not necessary and applicable law requires otherwise.
Use Across Marketing and Communication Channels
Subject to the provisions of this Section and the Provider's Privacy Policy, information, feedback, testimonials, approved promotional content and anonymised/aggregated insights may be incorporated into the Provider's:
- Website and digital platforms;
- social media and online advertising;
- SEO and content marketing;
- affiliate and referral marketing;
- email and video marketing;
- presentations and official materials;
- workshops, seminars and awareness programmes; and
- print and offline promotional materials, including brochures, flyers, posters, banners, magazines and similar media.
Withdrawal of Promotional Consent
Where the Receiver/s has provided consent for identifiable promotional or marketing use and subsequently does not wish such content to be used for future promotional activities, the Receiver/s may notify the Provider through the designated communication channel.
Upon receiving such request, the Provider shall take reasonable steps to discontinue the future use of the identified content for promotional purposes, subject to applicable law, existing publications, materials already distributed or published, technical limitations, contractual obligations and content that has already entered the public domain.
Withdrawal of promotional consent shall not affect the Provider's right to retain or use the information where such retention or use is otherwise permitted or required for service delivery, legal, accounting, security, recordkeeping, research, analytics or other legitimate purposes under the Provider's Privacy Policy and applicable law.
No Transfer of Ownership of Third-Party Content
The Receiver/s shall not upload photographs, videos, recordings, documents or other material belonging to another person unless the Receiver/s has the necessary authority or permission to do so.
Nothing in these Terms transfers ownership of content belonging to a third party to the Provider.
Privacy Policy to Apply
The collection, storage, processing, sharing, retention and protection of personal information contained in User Content shall be governed by the Provider's Privacy Policy, in addition to this Section.
Right To Suspend Or Cancel User Account
Suspension or Termination by the Provider
The Provider may, at its reasonable discretion, temporarily suspend, restrict or permanently terminate the Receiver/s' account, access to the Website or any Service, with or without prior notice, where the Provider reasonably determines that the Receiver/s has violated these Terms, Service-specific terms, applicable laws, or the rights, security or legitimate interests of the Provider or any other person.
Immediate Restriction for Serious Violations
The Provider may immediately suspend, restrict or terminate an account where the Receiver/s is found to engage in unlawful activities, cybercrime, unauthorised access, intellectual-property infringement, fraud, impersonation, or the posting, sharing or promotion of content that is hateful, threatening, abusive, sexually explicit, misleading, defamatory, discriminatory, related to terrorism or violent extremism, or otherwise prohibited under applicable law.
Effect of Suspension or Termination
Upon suspension or termination, the Receiver/s may immediately lose access to the Website, account, Course, Program, Psychometric Testing, materials, sessions, benefits and other Services associated with the account, subject to any rights or obligations that continue under applicable law or the relevant Service terms. The Provider may also restrict the creation or use of another account where reasonably necessary to prevent continued misuse or circumvention of the suspension or termination.
No Limitation of Legal Remedies
Suspension or termination of an account shall not prevent the Provider from taking any further action or pursuing any civil, criminal or other legal remedy available under applicable law for the Receiver/s' conduct.
Discontinuation by the Receiver/s
The Receiver/s may discontinue use of the Website or request closure of their account at any time through the designated process or communication channel of the Provider. Any cancellation, refund, fee, access period or other financial consequence shall be governed by the applicable Service-specific terms, cancellation policy and applicable law.
Paid Services & Subscription Periods
Where a paid Service is provided for a defined period, cancellation or discontinuation by the Receiver/s shall not automatically create a right to a refund or early termination unless expressly provided under the applicable Service terms or required by law. Where any Service is automatically renewed, the Receiver/s must cancel the renewal through the applicable process before the next renewal period to avoid further charges.
Indemnification
Indemnification by the Receiver/s
The Receiver/s agrees to indemnify, defend and hold harmless the Provider, Svastrino Consultancy Services, its directors, employees, team members, freelance consultants, professional associates, representatives, service providers and other persons acting on its behalf, from and against any third-party claims, demands, actions, losses, liabilities, damages, penalties, costs and reasonable legal expenses arising out of or relating to:
a) any breach or violation of these Terms or any applicable Service-specific terms by the Receiver/s;
b) any unlawful, fraudulent, negligent, abusive or unauthorised use of the Website, Services, account, content or information by the Receiver/s;
c) any infringement or violation of the intellectual-property, privacy, contractual or other legal rights of the Provider or any third party by the Receiver/s;
d) any content, information, material or communication submitted, uploaded, shared or transmitted by the Receiver/s through the Website or Services; or
e) any claim arising from the Receiver/s' acts, omissions, decisions or misuse of the Website or Services.
Education & Career Decisions
The Receiver/s acknowledges that education, career, course, institution, employment and other personal or professional decisions remain the responsibility of the Receiver/s. The Provider's Website and Services are intended to provide information, guidance, assessment and developmental support and do not constitute a guarantee of any particular academic, career, employment, admission, financial or other outcome.
To the extent permitted by applicable law, the Receiver/s agrees to indemnify and hold the Provider and the persons associated with it harmless from third-party claims, losses, liabilities, damages or reasonable legal expenses arising directly from the Receiver/s' independent decisions or actions based on, or in connection with, their use of the Website or Services, except to the extent caused by the Provider's proven wilful misconduct or other liability that cannot legally be excluded.
Scope of Indemnification
The obligations under this Clause shall apply to the extent that the relevant claim, loss or liability arises from the Receiver/s' conduct, breach, misuse, unlawful activity, or other act or omission for which the Receiver/s is legally responsible. This Clause shall survive the suspension, termination or discontinuation of the Receiver/s' account or Services to the extent necessary to address any such claim.
Right To Change And Modify Terms
Right to Modify
The Provider reserves the right to amend, update, modify, add to or remove any provision of these Terms from time to time, including to reflect changes in Services, Website features, technology, business practices or applicable laws and regulations.
Notice of Changes
The updated Terms shall be made available on the Website with the revised or effective date. Where the Provider makes a material change that substantially affects the rights or obligations of active Receiver/s, the Provider shall make reasonable efforts to notify such Receiver/s through the contact details available with the Provider or through an appropriate notice on the Website.
Receiver/s' Responsibility to Review
The Receiver/s is responsible for reviewing the Terms periodically and remaining aware of any amendments. The latest version published on the Website shall govern the Receiver/s' continued use of the Website and Services from its applicable effective date.
Acceptance of Modified Terms
The Receiver/s' continued access to or use of the Website or Services after the effective date of any amended Terms shall constitute acceptance of the revised Terms, to the extent permitted by applicable law.
Disagreement with Modified Terms
If the Receiver/s does not agree with any amended Terms, the Receiver/s shall discontinue accessing and using the Website and affected Services and may request closure of their account through the applicable process. Any rights, obligations, payments, cancellations or Services already in effect shall continue to be governed by the applicable terms and policies, subject to applicable law.
Legal Jurisdiction:
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of [India, Maharashtra], without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and the Receiver hereby consents to them being decided exclusively by a court of competent jurisdiction located in Mumbai, Maharashtra, India Only.
